West Virginia Permit Driving Restrictions: Supervision, Night Driving and Passenger Limits

West Virginia instruction-permit rules depend on the permit path. A Level 1 GDL permit holder under 18 has specific driving-hour, passenger, and wireless-device limits. A regular Class E instruction permit holder age 18 or older must still have an authorized person seated beside them while driving under the permit. For ordinary supervision, that can be a licensed driver age 21 or older; West Virginia law also recognizes an official driver-education or driving-school instructor, and the regular instruction-permit statute also lists a certified DMV license examiner acting officially. The Level 1-only limits should not be applied automatically to the adult permit.

Can West Virginia Permit Holders Drive Alone?

No. When driving under a West Virginia instruction permit on a public highway, the permit holder must have an authorized person seated beside them. For ordinary supervision, this is a licensed driver age 21 or older; the statutes also recognize specified official instructors, and the regular instruction-permit statute recognizes a certified DMV license examiner acting officially. West Virginia law does not support a blanket statement that every movement in a private parking lot or driveway is automatically an instruction-permit violation.

• Driving on public roads without the required supervisor violates the permit's supervision condition.
• For detailed penalties and licensing consequences, use the dedicated Driving Alone and Traffic Violations pages.

Who Can Supervise a West Virginia Instruction Permit Holder?

For ordinary supervised practice, the supervising driver must be licensed, age 21 or older, and seated beside the permit holder; the license does not have to be issued by West Virginia. West Virginia law also recognizes a driver-education or driving-school instructor acting in an official capacity, and the regular instruction-permit statute additionally recognizes a certified DMV license examiner acting officially.

2WV Level 1 Driving Hours and Locations

With the required supervisor present, a permit holder may practice on public roads. For a Level 1 GDL permit holder, driving is allowed only between 5:00 a.m. and 10:00 p.m..

• The 5:00 a.m.-10:00 p.m. restriction is a Level 1 GDL rule, not a blanket rule for every age-18+ instruction permit.
• For Level 2 eligibility, an under-18 applicant must complete either an approved driver-education course or 50 hours of supervised driving, including a minimum of 10 nighttime hours.
• If using the 50-hour route, use the official DMV practice log; a tracking app should not be presented as replacing the required certification.

For the full logging and driver-education alternative, use the Required Practice Hours guide.

Do WV Level 1 Permit Restrictions Still Apply After You Turn 18?

Turning 18 does not automatically erase the conditions on an existing Level 1 permit. The Level 1 permit remains valid until 30 days after the holder’s 18th birthday, and its Level 1 conditions continue while that permit is being used. The regular age-18+ instruction-permit path is a different permit category with different restrictions.

Can a West Virginia Level 1 Permit Holder Drive on the Interstate?

West Virginia’s Level 1 statute does not create a separate ban on interstate highways. A Level 1 permit holder may practice on public roads, including an interstate in West Virginia, as long as the qualified supervisor is beside the driver and all other Level 1 conditions are followed.

Can a Level 1 Permit Holder Drive After 10 p.m. for Work, School or an Emergency?

The Level 1 rule allows driving only between 5:00 a.m. and 10:00 p.m. The statute does not publish a general work, school, or emergency exception to that time restriction. Do not plan on one of those reasons as permission to drive outside the Level 1 window.

2West Virginia Level 1 Passenger Restrictions

During the Level 1 permit phase, the driver may have no more than two additional passengers unless those passengers are family members. The supervising adult must still be seated beside the permit holder.

• One or two non-family passengers may ride with a Level 1 permit holder when the required supervisor is present.
• Three or more non-family passengers are not allowed under the Level 1 passenger limit.
• Family members are not counted toward that two-passenger cap.
• Seat-belt and child-restraint laws still apply to everyone in the vehicle.

3Family Members and the WV Level 1 Passenger Limit

No. The Level 1 rule limits the driver to no more than two additional passengers unless those passengers are family members. Family members are not counted toward the two-non-family-passenger cap.

Can a WV Level 1 Permit Holder Use a Phone While Driving?

A Level 1 permit holder may not use a wireless communication device while driving except to contact 911. This is stricter than simply banning handheld calls or texting.

• No wireless communication device use while driving under a Level 1 permit, except for a 911 emergency call.
• The Level 1 permit holder must operate the vehicle with no measurable blood alcohol content. That condition applies to the permit holder, not every passenger under age 21.

Can a WV Level 1 Permit Holder Use a Hands-Free Phone While Driving?

No. The Level 1 restriction is broader than a handheld-phone ban: it prohibits using a wireless communication device while driving except to contact 911. A hands-free call should not be treated as an exception to the Level 1 rule.

2Level 1 Violations and Permit Consequences

Consequences depend on the specific violation and whether it results in a final conviction. Keep detailed solo-driving penalties on the Driving Alone page and general moving-violation effects on the Traffic Violations page.

For Level 2 eligibility, the Level 1 permit must have been conviction-free for the immediately preceding 180 days. A citation by itself should not be described as automatically resetting that period.

Pre-Drive Checklist Every WV Permit Holder Should Run

Before a Level 1 practice drive, confirm that the supervisor fits an allowed category and is seated beside the permit holder. For an ordinary supervising driver, that means a valid license and age 21 or older; an official driver-education or driving-school instructor is a separate statutory alternative. Also confirm that the drive is between 5:00 a.m. and 10:00 p.m. and that the Level 1 passenger limit is satisfied.

• Confirm the supervisor's license is currently valid; it does not have to be a West Virginia-issued license.
• If using the 50-hour route, record practice on the official DMV log and follow the Required Practice Hours guidance.
• Keep the instruction permit in the driver's immediate possession while driving. For lost, forgotten, or digital-credential questions, use the dedicated permit-possession/replacement pages.
• The Level 1 Instruction Permit remains valid until 30 days after the driver's 18th birthday.
