Your learner's permit does not instantly become invalid if the supervising driver becomes unqualified. You simply cannot continue driving until a qualified accompanying driver is present.
If police discover that the supervising driver is suspended, impaired, asleep, or otherwise unable to qualify, the supervised drive must stop. Continuing without a qualified accompanying driver can violate Virginia's learner-permit statute.
If you commit a traffic offense while driving, the citation is generally issued to you as the operator. A speeding, red-light or similar conviction can be posted to your own DMV record and carry demerit points.
The supervising adult can face a separate violation when their own conduct breaks the law or when they knowingly permit unlawful driving. The supervisor does not simply inherit the learner's traffic ticket.
Your permit remains a learner's permit, but it no longer authorizes you to continue that trip without a qualified accompanying driver. Stop driving and arrange for another qualified driver.
If you continue driving without the supervision required by § 46.2-335, you can violate the learner-permit statute, which is punishable as a Class 2 misdemeanor. Do not automatically label every supervisor problem as the separate driving-without-a-license offense.
A vehicle is not automatically impounded in every supervisor-related stop. Police may allow a qualified driver to take over, or the vehicle may need to be left or towed depending on the circumstances and other applicable laws.
Yes, but only if that passenger independently meets Virginia's learner-permit supervisor requirements, is alert and able to assist, and sits beside the learner before driving resumes. If nobody else qualifies, the learner must stop driving until a qualified driver is available.
Pull over promptly and safely. Turn off the engine. Hand the officer your permit card, the supervisor's license, and proof of insurance. Do not reach for documents without telling the officer first. Let the supervisor speak if the officer directs questions to the supervising driver.
Before every trip, confirm that your supervisor has a valid license and is legally permitted to drive. A printed card does not show every later suspension. If the person cannot lawfully supervise, do not start the drive. Towing or impoundment depends on the circumstances; it is not automatic for every supervisor problem.
| Situation | What It Means |
|---|---|
| The learner commits the traffic offense | The learner can receive the citation and demerit points. The supervisor does not automatically take the ticket. |
| The supervisor commits a separate offense | The supervisor can be cited or arrested for their own conduct. That does not erase the learner's responsibility for any separate driving offense. |
| The supervisor becomes legally unqualified during the trip | The learner must stop driving until another qualified supervising driver is available. Continuing can violate § 46.2-335. |
See the Virginia supervisor-requirements guide for the full age, relationship, licensing and seating rules. For penalties for continuing alone, see the driving-alone page.
Park safely off the road. Do not continue driving without another qualified supervisor, even for a short distance. Follow the officer's instructions about the vehicle. Arrange a qualified driver to collect it, or arrange a ride for yourself if it must remain parked or be towed. Contact the police non-emergency line if you need help with lawful retrieval.
Save the contact for a reliable, licensed family friend in your phone before you drive. This avoids panicked searches and delays, potentially reducing impound storage fees.
Arrange a backup who meets the Virginia supervisor requirements before you drive. Having that person available can help if your original supervisor becomes unqualified. Do not continue alone; the driving-alone penalties still apply.
"The AI mock tests were surprisingly realistic. The explanations for road signs helped me understand the logic, not just memorize. Passed my permit test on the first try!"
