Driving Restrictions
Utah Learner Permit Driving Restrictions: Supervision, Passengers, Night Driving and Phones
Utah learner permit holders must drive under supervision. Who can supervise depends on the driver's age. Permit holders may carry other passengers, and the midnight-to-5 a.m. curfew that applies to certain licensed 16- and 17-year-olds does not apply to learner-permit driving.
Learner Permit vs. Provisional License
| Rule | Learner Permit | Provisional License (16-17) |
|---|---|---|
| Supervision | Required every time you drive | Not generally required |
| Night driving | No permit-specific midnight-to-5 a.m. curfew | Midnight-5 a.m. restriction applies, with statutory exceptions |
| Passengers | Other passengers are allowed when the required supervisor is present | Passenger limits apply during the first six months or until age 18 |
| Phone use under 18 | Under-18 phone restrictions apply | Under-18 phone restrictions apply |
Can You Ever Drive Alone With a Utah Learner Permit?
No. A Utah learner permit does not authorize solo driving. A qualifying supervisor must be in the front passenger seat whenever you drive.
For drivers under 18, Utah allows several supervisor categories, including a licensed parent or legal guardian, an approved driving instructor, a licensed responsible adult who signed for financial responsibility, and a specific authorized 21+ route when the parent or legal guardian is not licensed. Drivers age 18 or older must have a licensed driver age 21 or older beside them. See the dedicated supervisor requirements guide for the full eligibility rules.
Permit Restrictions After Turning 18
Yes. Supervision is still required, but once you are 18 the person beside you must be a licensed driver age 21 or older. Turning 18 does not convert a learner permit into a full driver license or allow solo driving.
Utah's learner-permit statute does not create a solo-driving exception for work, school, or emergencies.
Passenger Rules for Utah Learner Permit Holders
Yes. Utah allows other passengers in the vehicle while you drive on a learner permit, as long as the required supervisor is in the front passenger seat.
| Situation | Allowed? | Condition |
|---|---|---|
| Driving with friends or siblings | Yes | Required supervisor remains in the front passenger seat |
| Driving with only the supervisor | Yes | Supervisor must meet the age and license rules for your permit |
| Driving alone | No | A learner permit does not authorize solo driving |
What Are Utah's Learner Permit Nighttime Driving Hours and Curfew Rules?
Nighttime Rules for Utah Learner Permit Holders
No. Utah's midnight-to-5 a.m. restriction applies to licensed drivers age 16-17, not to learner-permit driving. A learner permit holder may practice at night when the required supervisor is present.
If your licensing path requires practice hours, Utah generally requires 40 hours of practice driving, including 10 hours after sunset. The separate Required Practice Hours guide covers logging and completion details.
Where Utah Learner Permit Holders Can Drive
You may practice on public roads, including freeways, when the learner-permit supervision rules are met. The permit does not authorize solo trips to school, work, or other destinations.
Can a Utah learner permit holder use the I-15 Express Lane with a supervisor?
Yes, if the vehicle otherwise meets the Express Lane rules. UDOT says a carpool has two or more occupants, so a learner plus one supervisor meets the occupancy requirement. Follow the posted Express Lane entry, exit, vehicle, and speed rules.
Can a Utah learner permit holder drive to work or school?
Yes, as a supervised practice trip. Work or school does not create an exception that allows a learner permit holder to drive alone.
What Cell Phone and Zero-Tolerance Alcohol Rules Apply to Utah Permit Holders?
Drivers under 18 may use a wireless phone while operating a vehicle only in limited situations: a medical emergency, reporting or requesting help for a safety hazard, reporting or requesting help for criminal activity, or communicating with a parent or legal guardian.
Drivers age 18 and older must follow Utah's general wireless-device law. Alcohol and drug violations can trigger separate criminal and administrative consequences.
If You Break Utah Learner Permit Restrictions
The result depends on the specific violation. A learner-permit restriction violation may lead to a citation and can affect driving privileges; there is no single fixed fine, impoundment result, or waiting-period reset that applies to every case.
- Driving alone: not allowed on a Utah learner permit. See the dedicated Driving Alone penalties guide for the current offense and DLD consequences.
- Phone use under 18: Utah has a separate under-18 wireless-phone rule with specific exceptions.
- Alcohol or drug violations: separate criminal and administrative rules may apply. See the DUI on a Permit guide.
