A supervising driver must be at least 21, have at least one year of driving experience, hold a valid license that qualifies them for the vehicle, and sit in the front passenger seat. While supervising, the adult must stay awake, must not be intoxicated, and must not do anything that prevents them from observing and responding to the learner.
| Qualification | Conduct While Supervising |
|---|---|
| Age 21 or older; valid qualifying license; at least one year of driving experience; front passenger seat | Stay awake, do not supervise while intoxicated, and avoid activity that prevents proper observation and response |
Texas law sets strict criteria for a qualified supervising driver. The adult must sit directly beside the learner in the front passenger seat.
Out-of-state licensed adults can supervise if they are 21 or older, have at least one year of driving experience, and their valid license allows that vehicle type.
No. Texas requires at least one year of driving experience. The statute does not say the current license card must have been issued at least one year ago.
No. The supervising adult must hold a valid license that qualifies them to drive that type of vehicle.
| Person Type | Allowed? | Notes |
|---|---|---|
| Parent or legal guardian (21+) | Yes | Allowed when the adult meets the age, valid-license, experience, and seating requirements. |
| Older sibling or relative (21+) | Yes | A 21-year-old sibling can supervise if they have a valid license with one year of experience. The rule is based on qualifications, not relationship. |
| Friend, neighbor, or designated adult (21+) | Yes | No family tie needed if qualified; common for parent-taught courses |
| Out-of-state licensed driver (21+) | Yes | Valid out-of-state license accepted if the driver is 21 or older with at least one year of experience. |
| Certified driving instructor | Yes | TDLR-licensed with instructor certification; dual brakes in school vehicles |
Yes. The learner may continue with a different supervisor as long as the new adult independently meets the legal requirements and is seated beside the learner before driving resumes.
The supervising adult must remain able to watch the learner and respond when needed. Texas law specifically prohibits the supervisor from sleeping, being intoxicated, or engaging in activity that prevents proper observation and response.
If the supervisor's license is suspended or revoked, they cannot legally supervise any learner until their driving privilege is fully reinstated.
If the adult does not meet the legal supervisor requirements, the learner is no longer driving with a qualified supervisor. Separately, a supervising adult who sleeps, is intoxicated, or is too distracted can be charged under Texas Transportation Code 521.222(g).
Phone use is not automatically prohibited for the supervising adult. The legal issue is whether the activity prevents the supervisor from observing and responding to the learner's driving.
Teens must hold a learner license for at least six months and complete 30 additional hours of supervised practice, including at least 10 at night. This page covers who may supervise those drives; the Required Practice Hours page covers the full hour and log requirements.
If your learner license is ever suspended, the six-month holding period is extended by the exact number of suspension days; it does not restart from zero.
DPS appointments, application documents, fees, and knowledge testing are covered in their dedicated guides rather than in the supervisor rules.
Vehicle inspection and road-test requirements are separate from the rules that determine who may supervise a learner.
If the learner drives without a qualified supervisor, use the dedicated Driving Alone page for the applicable citation and suspension rules.
"The AI mock tests were surprisingly realistic. The explanations for road signs helped me understand the logic, not just memorize. Passed my permit test on the first try!"
