Texas Learner License Driving Restrictions: Supervision, Cell Phone, Night and Road Rules

Texas learner-license holders must follow the restrictions printed on the credential and the rules that apply to the learner phase. You cannot drive alone, and a suspension during the learner period extends the six-month holding period by the number of suspension days rather than restarting it from zero.

Driving Alone Is Not Allowed With a Texas Learner License

You cannot drive alone with a Texas learner license. A qualified supervisor must sit in the front passenger seat while you drive. Detailed age, license, experience, and conduct rules belong to the separate supervisor-requirements guide.

• Supervisor: A qualified supervising driver must sit beside you in the front passenger seat for the entire time you are driving.
• Driving 'just around the block' or dropping off your supervisor to finish a trip alone is illegal.
• Restriction violation: Operating contrary to a learner-license restriction can carry a fine of up to $200. A suspension is not automatic after one violation; Texas law allows suspension after specified conviction triggers, including two restriction-violation convictions.

Before driving, make sure the person supervising you still meets Texas's legal requirements. If you are stopped while driving without a qualified supervisor, the driving-alone rules apply.

What You Can and Cannot Do With a Texas Learner License

A Texas learner license allows supervised driving on public roads to gain experience. Here's what's permitted and what crosses the line.

Do Texas provisional-license curfew and passenger rules apply while I still have a learner license?

No. The learner phase uses its own supervision rules. The provisional passenger and time restrictions apply after you move to the provisional license stage.

• You CAN:
  • Drive on all public roads, including freeways, with a supervisor
  • Drive to school, work, or activities with a supervisor present for the entire trip
  • Drive at night with a supervisor
  • Drive through a drive-thru while the supervisor is present
  • Have unlimited passengers, no passenger restrictions apply to learner permit holders
• You CANNOT:
  • Drive alone under any circumstances
  • Have a supervisor in the back seat or a follow car
  • Use a cell phone for any reason while driving (emergency 911 calls excepted)
  • Have any detectable alcohol in your system if under 21

What if another restriction code is printed on my learner license?

Follow every restriction printed on the credential in addition to the normal learner-license rules. For example, a corrective-lenses or other individual restriction still applies while you are driving under supervision.

A driving-alone citation does not automatically restart the learner period. If a later DPS suspension applies, the six-month holding period is extended only by the number of suspension days. Detailed enforcement and suspension rules are covered in the driving-alone penalties guide.

Night Driving and Freeways: The Actual Rules

Night driving is allowed with a qualified supervisor. Texas does not create a general learner-license freeway ban. Teen driver education separately includes 7 hours of instructor driving, 7 hours of in-car observation, and 30 additional supervised practice hours, including at least 10 hours at night.

Can a Texas learner drive on toll roads, interstates and freeways?

Yes, the learner license itself does not create a general ban on those roads when you are properly supervised. You still must follow any individual restriction printed on your license and all normal traffic laws.

For the full practice-hour breakdown and logging rules, use the separate Required Practice Hours guide.

Common Learner-License Situations and How the Rules Apply

These common situations still fall under the learner-license supervision and restriction rules.

• Supervisor using a phone: Phone use is not automatically an offense. The supervisor violates the rule if the activity prevents them from observing and responding to your driving.
• Moving a Car in a Driveway/Parking Lot: Operating a vehicle on any property accessible to the public is considered driving. A supervisor must be present in the front seat.
• Driving to school is permitted only with a supervisor in the front seat for the entire journey, including arrival and parking.
• Other license restrictions: If your credential lists another restriction, such as corrective lenses, you must follow it during every supervised drive.

The key question is whether the supervisor remains able to watch the learner and respond when needed. The learner remains responsible for obeying the traffic laws while driving.

What Happens If You Violate a Learner-License Restriction

Different violations can lead to different consequences, so do not treat every learner-license mistake as the same offense.

• Driving contrary to a learner restriction: Can carry a fine of up to $200. A suspension is not automatic after one restriction violation.
• If DPS suspends the learner license: The six-month holding period is extended by the number of suspension days.
• Supervisor conduct: The supervisor has a separate offense if they sleep, are intoxicated, or become too distracted to properly observe and respond to the learner.
• Alcohol or other traffic offenses: Separate rules apply. Use the dedicated DUI and traffic-violation guides for those penalties.

For detailed driving-alone penalties, traffic violations, DUI consequences, practice hours, or supervisor qualifications, use the dedicated page for that topic rather than treating this overview as a complete penalty guide.
