Ohio Learner's Permit Restrictions: Supervision, Night Driving, Passengers, and Phone Rules

An Ohio TIPIC lets you practice driving only when you follow Ohio's permit conditions. Download the Ohio Digest of Motor Vehicle Laws PDF for the full rules. Driving without the required supervisor violates the TIPIC conditions. For drivers under 18, an electronic-device violation carries a $150 fine and 60-day suspension for a first offense; a qualifying repeat offense carries a $300 fine and one-year suspension.

Can You Drive Alone With an Ohio Learner's Permit - Even Around the Block?

No. A TIPIC holder must have a qualified supervising driver on public roads. If you are 16 or older, you may generally drive with a valid licensed driver age 21 or older in the front passenger seat.

From midnight to 6 a.m., you need a parent, guardian, custodian, or a licensed driver age 21 or older named on notarized BMV 2438.

Who Must Be With You While Driving on an Ohio TIPIC?

A qualified supervisor must be in the front passenger seat whenever you drive on an Ohio TIPIC.

• Under 16: You must drive with an eligible adult under Ohio law. This can include a parent, guardian, custodian, licensed driving instructor, or another person who qualifies under the statutory eligible-adult rules.
• Ages 16–17: From 6 a.m. to midnight, a valid licensed driver age 21 or older may supervise. From midnight to 6 a.m., the stricter eligible-adult rule applies.
• Age 18+: A valid licensed driver age 21 or older must be in the front passenger seat while you practice.

Driving alone while you hold a valid TIPIC violates Ohio's permit conditions. Under ORC 4507.05, a violation of those operating conditions is a minor misdemeanor. Detailed driving-alone consequences belong on the dedicated driving-alone penalty page.

What Roads and Conditions Can Ohio Permit Holders Actually Drive On?

You can drive on any Ohio public road, including freeways, with a qualified supervisor.

Driver-education and practice-hour requirements vary by age and are separate from the rules about where and with whom you may drive.

Permitted Driving Areas and Practice Tips

You are legally allowed on all roadways, including interstates. A recommended practice progression is:

1. Hours 0-10: Empty parking lots and quiet residential streets (25 mph or less).
2. Hours 10-20: Busier commercial roads (35-45 mph).
3. Hours 20-30: Rural highways (55 mph).
4. Hours 30+: Short freeway trips during light traffic, then progressing to complex merges.

Do Not Skip This: Do not attempt I-270 in Columbus during rush hour as a beginner. A Dayton teen with only 6 hours of practice panicked on a highway on-ramp, causing a multi-car collision.

Can you practice with an Ohio TIPIC in a store parking lot without a supervisor?

No. The TIPIC supervision requirement still applies while you are operating the vehicle in areas open to public vehicle travel or parking. A parking lot is not a workaround for solo practice.

Ohio TIPIC Night Driving, Passenger, and Phone Rules

Night Driving and Curfew Rules

For TIPIC holders under 18, Ohio applies a stricter supervision rule from midnight to 6 a.m. The learner still cannot drive alone.

Age 18 or older: The minor TIPIC midnight restriction no longer applies, but a valid licensed driver age 21 or older must still supervise every practice drive.

Can an Ohio TIPIC holder drive between midnight and 6 a.m. with a 21-year-old supervisor?

Not automatically if the permit holder is under 18. During those hours, the stricter eligible-adult rule applies. A normal daytime 21+ supervisor does not always qualify for the midnight-to-6 a.m. period.

Does Ohio's learner-permit curfew apply after you turn 18? No. The under-18 midnight restriction ends at 18, but the TIPIC holder still needs a licensed driver age 21 or older in the front passenger seat.

Passenger and Seat-Belt Rules for Ohio TIPIC Holders

The one-non-family-passenger limit belongs to Ohio's probationary-license stage, not the standard TIPIC rule. While you have a TIPIC, the number of occupants cannot exceed the vehicle's originally installed restraint capacity, and required restraints must be used.

Does an Ohio TIPIC have the same passenger limit as a probationary license?

No. The probationary one-non-family-passenger rule is a post-TIPIC restriction. A TIPIC holder must instead follow the permit supervision rule and the vehicle's occupant/restraint limits.

How many passengers can ride with an Ohio TIPIC holder? Ohio does not apply the probationary one-non-family-passenger limit to the TIPIC itself. Do not carry more occupants than the vehicle's installed restraint capacity, and make sure required seat belts or restraints are used.

Cell Phone and Electronic Device Ban

Drivers under 18: Ohio sharply restricts electronic-device use while driving. A narrow exception allows a navigation device to be used in a voice-operated or hands-free manner as long as the driver does not manipulate the device while driving.

Drivers 18 and older: Ohio's general hands-free law applies. Holding or manually using the device while driving can violate the law.

Can an Ohio permit holder use hands-free GPS before age 18?

Yes, within the statutory navigation exception. The navigation device must be used in a voice-operated or hands-free manner, and the driver cannot manipulate it while driving.

Driving to School or Work

A TIPIC holder still needs the required supervisor when driving to school, work, or another destination. Work, school-sponsored-event, and religious-event exceptions that may apply to probationary-license restricted hours do not turn a TIPIC into a solo-driving credential.

Driver education, the 50-hour practice requirement, and the waiting period are separate licensing requirements. They are covered on their dedicated Ohio pages rather than repeated here.

Practical tip: Carry your TIPIC and any supervisor documentation that applies to your situation whenever you practice.
