North Carolina Learner Permit Restrictions: Supervision, Driving Hours, Passengers, and Phone Rules

North Carolina's Level 1 Limited Learner Permit requires a qualified supervising driver whenever you drive. During the first six months, you may drive only from 5:00 a.m. to 9:00 p.m. After six months, the time restriction ends, but the supervision requirement remains until you move to the next licensing level.

You cannot drive alone with a Level 1 permit.
Only the supervising driver may occupy the front passenger seat; other occupants must be properly restrained.
Drivers under 18 are generally prohibited from using a mobile phone while the vehicle is moving, subject to limited statutory exceptions.
Different restriction violations carry different consequences; there is no single penalty that applies to every Level 1 violation.

Supervision Rules for NC Permit Holders: No Solo Driving, Period

Level 1 permit holders cannot drive alone. The supervising driver must meet North Carolina's qualification rules and sit in the front passenger seat beside the learner.

You may practice on public roads, including interstates and highways, when the required supervisor is present.
There is no general school, work, or hardship exception that allows a Level 1 permit holder to drive alone.
Driving without the required supervisor is treated separately from simply forgetting to carry the physical permit.

For detailed penalties for driving without a supervisor, use the North Carolina Tickets & Suspensions guide.

Time and Passenger Rules for a North Carolina Level 1 Permit

Rule	First 6 Months	After 6 Months
Driving hours	5:00 a.m. to 9:00 p.m.	The Level 1 time restriction ends.
Supervisor	Required for every drive.	Still required for every drive.
Passengers	Only the supervising driver may sit in the front passenger seat. Other occupants may ride if properly restrained.	Same Level 1 passenger rule.
Phone use under 18	Restricted while the vehicle is moving, subject to limited statutory exceptions.	Same rule.

Can friends ride in the back seat with a North Carolina Level 1 learner permit?

Yes. Level 1 does not impose the Level 2 family-only or under-21 passenger limits on back-seat passengers. The supervising driver must occupy the front passenger seat, and everyone in the vehicle must be properly restrained.

Can I drive after 9 PM once I have held my Level 1 permit for six months?

Yes, but only with the required supervising driver. The 5:00 a.m. to 9:00 p.m. restriction applies during the first six months; completing six months does not create solo-driving privileges.

See G.S. 20-11 for the current Level 1 restrictions.

Where NC Permit Holders Can Drive: No Geographic Restrictions

North Carolina does not impose a separate Level 1 ban on interstate or highway practice. You may practice on public roads when the required supervising driver is seated beside you and the other Level 1 restrictions are followed.

Road-test office selection, wait times, and appointment strategy are covered separately in the North Carolina Road Test & License and appointment guides.

Safety and Phone Rules for North Carolina Permit Drivers

Drivers under 18 generally may not use a mobile phone while operating a moving vehicle. The restriction applies to the learner who is driving, not automatically to a supervising passenger using their own phone.

Can a North Carolina learner permit holder use a phone in an emergency or call a parent?

North Carolina law includes limited exceptions, including emergency communications and calls to a parent, legal guardian, or spouse. The under-18 mobile-phone restriction applies while the vehicle is moving; use while the vehicle is lawfully stopped is treated differently. See G.S. 20-137.3.

North Carolina's under-21 alcohol law does not use a 0.01% threshold. It applies when an under-21 driver is consuming alcohol or has any alcohol remaining in the body. A separate civil revocation can apply when the conditions in the civil-revocation law are met. Detailed alcohol/DWI consequences belong in the North Carolina Tickets & Suspensions guide.

Everyone in the vehicle must be properly restrained. Driving-log requirements are covered separately in the Required Practice Hours guide.

What Happens If You Violate a North Carolina Level 1 Permit Restriction?

The consequence depends on the restriction. North Carolina does not treat every Level 1 violation as the same misdemeanor.

Violation	How It Is Treated
Driving without the required supervisor or outside the permitted hours during the first six months	Treated under the no-license provisions referenced by G.S. 20-11.
Mobile-phone violation by a driver under 18	A separate infraction with a $25 penalty under the under-18 mobile-phone statute.
Other Level 1 seating/passenger restriction violations	Handled as infractions rather than a blanket Class 3 misdemeanor.
Level 2 eligibility after a qualifying conviction	The nine-month Level 1 holding period does not restart. A qualifying moving violation, seat-belt infraction, or mobile-phone violation can delay eligibility because the applicant must satisfy the separate six-month clean-record requirement.

For detailed fines, court consequences, insurance effects, and violation-specific suspension rules, use the North Carolina Tickets & Suspensions pages rather than treating every restriction violation the same.
