New York Supervising Driver Rules: Age, License, Regional Limits, and Documentation

To practice driving with a New York learner permit, you need a supervising driver who meets the state's age and licensing rules. Junior permit holders have additional regional restrictions.

Supervisor age and license requirements

For every learner permit holder, the supervisor must be at least 21 and have a license valid in New York for the type of vehicle being driven. The license does not have to be issued by New York if it is otherwise valid for driving in New York.

The supervising driver must sit in the front passenger seat, and a learner permit holder cannot drive alone at any age.

Can someone with an out-of-state driver's license supervise a New York learner permit holder?

Yes, if the driver's license is valid in New York and valid for the type of vehicle being used. The key rule is that the supervisor is at least 21 and properly licensed for that vehicle.

Can a 21-year-old friend or sibling supervise a New York learner permit holder?

It depends on the learner's age, region, and time of day. For an adult learner permit holder, a qualified driver age 21+ can supervise. For a junior permit holder, Upstate daytime driving can be supervised by any qualified person age 21+, but New York City, Long Island, and Upstate nighttime driving have narrower supervisor rules.

Does New York have a special alcohol rule for supervising drivers?

New York's learner-permit rules do not create a separate “any detectable alcohol” or special Zero Tolerance BAC rule for supervising drivers. Do not rely on an impaired or otherwise legally unable driver as the required supervisor.

If the supervisor becomes unable to supervise because of arrest, illness, impairment, or a license problem, stop the practice drive until another legally qualified supervisor can take over. Detailed traffic-stop scenarios belong in the Supervisor Pulled Over article.

Approved supervisors for junior permit holders in NYC, Long Island, and Upstate New York

Junior permit supervision changes by region. The table below keeps only the supervisor rules needed for this article; the full driving restrictions belong in the Driving Restrictions guide.

Can a written-designated adult supervise a junior permit holder on Long Island?

Yes. From 5 AM to 9 PM in Nassau or Suffolk County, a junior permit holder may be supervised by a person designated in writing by the learner's parent, guardian, or person in loco parentis, as long as that supervisor is at least 21 and properly licensed.

Form MV-262 signing responsibility

For a junior permit holder who is 16 or 17 at the road test, Form MV-262 is signed by a parent or guardian to certify that the learner completed at least 50 hours of supervised driving, including 15 hours after sunset. It is not a form that each ordinary supervisor signs after every practice session.

Hours completed with a licensed driving school instructor or driver education teacher can be certified in the school section of the form. Detailed hour logging belongs in the Required Practice Hours guide.

Who signs Form MV-262 if several different people supervised the learner?

The parent or guardian signs the main certification even when different qualified adults supervised some of the practice. If hours were completed with a licensed driving school instructor or driver education teacher, the school can certify those hours in the section provided on MV-262.
