New York Learner Permit Driving Restrictions: Supervision, Road Limits, Curfews, and Passenger Rules

New York learner permit rules depend on your age, location, and time of day. Every learner permit holder must drive with a qualified supervisor, and junior permit holders have extra regional restrictions.

Who can legally supervise a New York learner permit holder on the road?

For every New York learner permit holder, the supervising driver must be at least 21 and have a license valid in New York for the type of vehicle being driven. You cannot drive alone with a learner permit, even after turning 18.

Junior permit holders have additional regional rules about who may supervise in New York City, Long Island, and Upstate New York. See the dedicated supervisor-requirements guide for the full supervisor rules.

Do New York learner permit restrictions change after you turn 18?

Some junior-driver restrictions are age-based, but a learner permit still requires supervision after age 18. As long as you hold a learner permit, you must drive with a supervising driver who is at least 21 and properly licensed for the vehicle.

Geographic restrictions on supervised driving with a New York permit

Junior permit rules change by region. This table keeps the main differences in one place.

Current regional rules are published by New York DMV at dmv.ny.gov/driver-license/learner-permit-restrictions.

Can you drive outside New York with a New York learner permit?

Yes, if the state you are visiting allows it. You must follow that state's learner-permit restrictions while driving there. Check the motor vehicle agency or police in the destination state before you drive.

Can someone with an out-of-state learner permit drive in New York?

If you are under 16, you cannot drive in New York with an out-of-state permit. If you are 16 or older, your home-state permit must be valid outside that state, and you must follow both your issuing state's restrictions and New York's learner-permit rules. Drivers under 18 must also follow New York's regional junior restrictions.

Can a New York learner permit holder drive in a parking lot or on private property?

Do not treat a parking lot or private property as an automatic exemption from learner-permit rules. New York DMV does not publish a blanket private-property exception in its learner-permit guidance. If you are practicing anywhere that is open to traffic or may connect to a public road, use a qualified supervisor and follow the applicable local rules.

Passenger limits for a New York junior learner permit holder

A junior permit holder generally cannot have more than one passenger under age 21 who is not an immediate family member. More than one passenger under 21 is allowed when the additional passengers are immediate family members or when the supervising driver is the junior driver's licensed parent, guardian, person in loco parentis, driver education teacher, or driving school instructor. The supervising driver is the only person allowed in the front seat.

Adult learner permit holders are not subject to this junior passenger-count rule, but they still need a qualified supervisor.

When can a New York junior permit holder drive at night?

New York City and Long Island junior permit holders cannot drive from 9 PM to 5 AM. Upstate junior permit holders may drive during those hours only under the direct supervision of a parent, guardian, person in loco parentis, driver education teacher, or driving school instructor who is at least 21 and properly licensed.

Junior road-test applicants must also complete 50 hours of supervised practice, including 15 hours after sunset. Detailed practice-hour tracking and Form MV-262 guidance belong in the Required Practice Hours guide.

Highways and roads off-limits for New York learner permit holders

New York DMV lists specific places where learner permit holders cannot drive:

• Any street within a park in New York City.
• Any bridge or tunnel under the jurisdiction of the Triborough Bridge and Tunnel Authority.
• The Cross County, Hutchinson River, Saw Mill River, and Taconic State parkways in Westchester County.
• Any DMV road-test area, except while taking the road test.

These restrictions apply in addition to the normal supervision and regional junior-permit rules.

Driving to School With a New York Permit Requires a Supervisor

A learner permit does not let you drive to school alone. You still need a qualified supervisor and must follow any regional junior-permit rules that apply where you are driving.

For detailed penalties for driving alone, use the dedicated Driving Alone article rather than treating every restriction violation as the same offense.

Phone and alcohol rules for New York learner permit holders

New York prohibits hand-held mobile-phone use and prohibited portable-electronic-device use while driving. A hands-free telephone is not covered by the blanket hand-held-phone ban, although the driver must still avoid unsafe distraction. For junior drivers, a first qualifying cell-phone or texting conviction can trigger a 120-day suspension.

For drivers under 21, New York's Zero Tolerance rule applies at a BAC of .02% to .07%. A first Zero Tolerance finding carries a six-month suspension. DWAI, DWI, chemical-test refusal, and repeat offenses follow different rules, so use the dedicated DUI-on-a-Permit article for the full penalty details.

New York permit violations: effects on suspension and road-test eligibility

A permit violation can lead to fines, points, suspension, or revocation depending on the actual offense and the driver's age. Detailed violation penalties belong in the Traffic Violations on Permit article.

For a junior permit holder, time when the permit is suspended or revoked does not count toward the six-month valid-permit requirement. That can move the road-test eligibility date later; the six-month period does not automatically restart from zero.

Junior road-test applicants must also meet the separate supervised-practice and pre-licensing requirements. Use the Waiting Period and Required Practice Hours guides for those details.
