New Mexico Learner's Permit Driving Restrictions: Supervision, Night Driving, Passengers, and Freeways

New Mexico instructional-permit drivers must follow supervision, seat-belt, traffic-violation, and under-21 alcohol rules. The sections below explain who may supervise, what restrictions apply while driving, and how violations can affect the permit timeline.

Can I Drive Alone With a New Mexico Learner's Permit?

No. A qualified supervising driver must sit beside you whenever you drive on a New Mexico instructional permit. Driving alone violates the permit restriction. A qualifying traffic-violation conviction while driving on the permit adds 30 days to the minimum holding period. For detailed citation and licensing consequences, see the Driving Alone penalties guide.

Driving Restrictions With a New Mexico Learner's Permit

The main rule is supervision by a qualified driver seated beside you. New Mexico also prohibits texting while driving. For drivers under 21, a qualifying chemical-test result of 0.02% or higher can trigger a one-year administrative revocation; criminal DWI rules are separate. Motorcycle instruction permits do not allow passengers.

Can you text while driving with a New Mexico learner's permit?

No. New Mexico law prohibits reading or viewing a text message or manually typing one while driving, subject to the law's limited exceptions.

Can I Drive on the Freeway With a New Mexico Learner's Permit?

Yes. New Mexico does not create a separate freeway ban for an instructional permit holder who is driving with a qualified supervisor. There is no state rule requiring a specific number of freeway practice hours.

See the New Mexico driving-rules guide for related supervised-driving rules.

Can You Drive at Night With a New Mexico Learner's Permit?

Yes. The instructional permit itself does not have the provisional-license midnight-to-5 a.m. curfew. You must still drive with a qualified supervisor. For drivers under 18 following GDL, 10 of the required 50 supervised practice hours must be completed at night.

For the full 50-hour log requirements, see the practice-hours guidance.

Passenger Rules With a New Mexico Learner's Permit

For a standard Class D instructional permit, the key requirement is that the qualified supervisor sits beside the permit holder and all occupants follow seat-belt laws.

Can a motorcycle instruction permit holder carry a passenger in New Mexico?

No. New Mexico law specifically prohibits carrying a passenger while operating under a motorcycle instruction permit.

Permit vs. Provisional License: How Restrictions Compare

An Albuquerque teen waited 8 months for her provisional license because a seatbelt citation in month 5 reset her 90-day clean-record clock. Violations can delay your progression and may reset the 90-day clean driving requirement before you can advance to the provisional license stage.

Download the official GDL Driving Log before you start practicing. A Clovis teen's road test was delayed two weeks because a homemade log was rejected. Get the NM Driver Manual at mvd.newmexico.gov. Ages 18-24 need the 'None for the Road' course from unm.edu before their license. Check your local MVD hours at mvd.newmexico.gov/locations.
