New Jersey Permit Driving Restrictions: Supervision, Curfew, Passenger and Highway Rules

A New Jersey learner's permit never allows solo driving. A qualified supervising driver must be in the front passenger seat whenever you drive. Some GDL limits change for Examination Permit holders age 21 or older.

Can You Drive Alone with a New Jersey Learner's Permit

No. A New Jersey learner's permit does not allow solo driving under any circumstance. Every time you drive, a qualified supervising driver must be physically present in the front passenger seat.

New Jersey Supervisor Requirements

A qualified supervisor must be at least 21, hold a valid New Jersey driver's license, have at least three years of driving experience, and sit in the front passenger seat. See the Supervisor Requirements article for the full qualification rules.

What Counts as "Driving": Driveways and Parking Lots

• Moving a car within a private driveway or enclosed private property is generally not regulated under NJ's permit law, as it is not a public roadway.
• However, the moment the vehicle enters a parking lot shared with others, a street, or any publicly accessible surface, permit rules apply and a supervisor must be present.
• When in doubt, have your supervisor in the seat. a parking lot citation is not worth the risk.

If the 50-hour supervised-driving requirement applies to you, see the Required Practice Hours article for the certification rule.

What an NJ Permit Holder Can and Cannot Do

A New Jersey permit allows supervised driving on public roads when a qualified adult is in the front passenger seat. Age-based GDL rules also apply.

Under 21 vs. Age 21+ Examination Permit Rules

Do drivers age 21+ need red GDL decals while driving on an examination permit?

No. The hour, passenger, and decal restrictions do not apply to an Examination Permit holder who is 21 or older. Supervision, seat-belt, and electronic-device rules still apply.

Curfew, Highway and School-Driving Rules

Permit holders cannot drive alone. A qualified supervising driver must sit in the front passenger seat whenever the permit holder is driving.

Are New Jersey permit restrictions different once you turn 21?

Yes, for an Examination Permit. At age 21 or older, the 11:01 PM–5:00 AM restriction, passenger limit, and red-decal rule no longer apply. You still need a qualified supervisor until you complete the required supervised period and pass the road test, and the electronic-device and seat-belt rules still apply.

Night Driving Restrictions

If you are under 21, you generally cannot drive between 11:01 PM and 5:00 AM. The restriction may be waived for a qualifying emergency or for bona fide employment or religious activity with the required written verification. The hour restriction does not apply to an Examination Permit holder who is 21 or older.

Can I drive after 11:01 PM for work or religious reasons with an NJ permit?

Yes, if you qualify for the employment or religion-related exception and carry written verification from the employer or religious authority in the form required by MVC. A qualifying emergency may also be treated as an exception under state law.

Does having a parent in the car let me drive after 11:01 PM?

No. A parent or guardian can affect the passenger restriction, but their presence does not by itself cancel the under-21 curfew.

Highway and Freeway Driving

• There is no blanket ban on highway or freeway driving with a New Jersey learner's permit.
• you can drive on the Garden State Parkway, I-95, or any other highway as long as your qualified supervisor is in the front passenger seat and it is within permitted hours.
• Highway practice is actually encouraged to build confidence before the road test.

Driving to School

Yes, you can drive to school with a learner's permit, but only with a qualified supervisor in the front passenger seat. Driving yourself to school alone is not permitted regardless of distance or time of day.

Passenger Restrictions with a New Jersey Learner's Permit

Passenger limits depend on the permit type and the driver's age.

• Special Learner's Permit: parents, guardians or dependents may ride, plus one additional passenger.
• Examination Permit under 21: dependents do not count toward the one-additional-passenger limit, and the limit does not apply when the permit holder is accompanied by a parent or guardian.
• Examination Permit age 21+: the GDL passenger restriction does not apply.
• Every occupant must use the required seat belt or child restraint.

Can You Drive with Friends in the Car

If you are under 21, a friend generally counts as the one additional passenger allowed under the GDL passenger rule. The exact rule depends on whether you hold a Special Learner's Permit or an Examination Permit. For an Examination Permit holder age 21 or older, the GDL passenger restriction does not apply.

Cell Phone and Electronic Device Rules for Permit Holders

Permit holders may not use hand-held or hands-free interactive wireless devices while driving, except in an emergency. The direct GDL penalty for violating this restriction is $100.

Permit Holder Cell Phone Restrictions

• The restriction covers both hand-held and hands-free interactive wireless communication devices.
• It applies to permit holders even when a qualified supervisor is in the vehicle.
• The statute provides an emergency exception.

Can I use GPS or hands-free navigation while driving on an NJ permit?

Do not operate or interact with a phone or other interactive wireless device while the vehicle is moving. MVC does not publish a separate learner-permit exception that makes hands-free phone use or active GPS interaction generally allowed. Set navigation before driving and avoid interacting with the device while moving.

What If Your Supervisor Is Texting or on the Phone

• This is a real and common issue.
• If a supervisor is distracted, including texting, on a call, or not paying attention.
• Both the permit holder and the supervisor can face consequences.
• The supervisor is legally responsible for actively overseeing your driving.
• A distracted supervisor is not fulfilling that legal obligation.
• If law enforcement stops the vehicle and determines the supervisor was not providing adequate oversight, the supervisor can be cited.
• The permit holder may also face scrutiny if the stop was triggered by erratic driving.
• The practical takeaway: if your supervisor picks up their phone, pull over safely and wait until they put it down.

Drive-Thru Scenarios with a Learner's Permit

For example, a permit holder may use a drive-through while the qualified supervisor remains in the front passenger seat; ordering food does not change the normal supervision requirement.

• There is no New Jersey law that prohibits a permit holder from driving through a drive-thru lane.
• The permit holder can operate the vehicle through the lane.
• Who places the order is not regulated. either the driver or supervisor can order.
• What matters is that the supervisor remains in the front passenger seat and the vehicle stays within permitted hours and all other restrictions are met.

Penalties for Learner's Permit Violations in New Jersey

A direct violation of New Jersey's GDL conditions carries a $100 fine. If the same stop also involves a separate moving violation or another offense, that separate violation can have its own points, fines, or licensing consequences.

• Driving without the required supervisor: $100 GDL restriction fine.
• Violating the under-21 curfew: $100 GDL restriction fine when no permitted exception applies.
• Violating the permit electronic-device restriction: $100 GDL restriction fine.
• Passenger, seat-belt, or decal restriction: $100 GDL restriction fine where the restriction applies.

How to Avoid Common NJ Permit Restriction Violations

Keep the rules simple: use a qualified supervisor, follow the passenger and curfew limits that apply to your age and permit, keep your phone out of use while driving, and make sure everyone is buckled.

• Use a practice log if it helps you track supervised hours. The detailed Share the Keys log is recommended, while Form BA-CSD is the certification MVC accepts for the 50-hour requirement.
• Before each drive, make sure your supervisor still holds a valid New Jersey driver's license.
• If the under-21 curfew applies to you, plan to stop driving before 11:01 PM unless you qualify for an allowed employment, religious, or emergency exception.
• If you are unsure whether a restriction applies at age 21+, check the age comparison above before driving.
