Nevada Permit DUI: Under-21 0.02 Suspension vs DUI Revocation

Nevada treats an under-21 alcohol result of 0.02% to below 0.08% differently from a DUI conviction. The under-21 rule carries a 90-day administrative suspension, while a first DUI conviction carries a minimum 185-day revocation.

Immediate Nevada Alcohol and DUI Penalties for Permit Holders

Do not combine Nevada's under-21 0.02 rule with the separate DUI revocation rule.

A DUI case may also involve criminal fines, DUI school, a victim impact panel, ignition-interlock requirements and insurance consequences. See the Nevada DMV DUI guidance and NRS Chapter 483.

Is a 0.02 BAC Automatically a DUI If You Are Under 21?

No. Nevada's under-21 rule covers an alcohol concentration of 0.02% or more but below 0.08% with a 90-day administrative suspension. A DUI charge or conviction is a separate matter and can arise from a higher alcohol concentration or impairment-based evidence.

What Happens to an Instruction Permit After a First DUI?

A first DUI conviction triggers the DUI revocation process rather than the ordinary demerit-point system. The permit holder must complete the applicable revocation and reinstatement requirements before driving privileges are restored.

Criminal Court Process and Legal Outcomes

If you are under 18, the case may proceed through juvenile court. Court outcomes depend on the actual charge, test result and case facts.

Administrative Suspension with Nevada DMV

The administrative process is separate from the criminal case. For the under-21 0.02 suspension, Nevada law allows a written hearing request while the suspension is in effect. Nevada DUI revocation law likewise provides an administrative review process while the driver remains ineligible.

There is no universal seven-day forfeiture deadline of the kind previously stated here. Follow the instructions on the DMV order and use the Nevada DMV Office of Administrative Hearings for the current request process.

How Long Do Nevada Under-21 Alcohol Suspensions and DUI Revocations Last?

A DUI conviction creates lasting barriers beyond the initial suspension. The conviction stays on your DMV record for 10 years for penalty enhancement.

• Any future violation is treated more harshly due to your DUI history
• The DUI remains on your criminal record for at least 7 years before it can be sealed
• Expect policy cancellation and higher insurance rates

You must file an SR-22 Certificate for 3 years, increasing annual premiums by $900 to $1,000.

Background checks for jobs, military service, and college scholarships will flag the conviction. A Reno teen with a permit DUI had his application for a summer internship at a local logistics company rejected after the background check.

Does a DUI on a permit delay getting a full Nevada license? Yes. A suspension or revocation prevents the permit holder from moving forward with normal licensing until driving privileges are restored and any applicable licensing requirements are met.

Restoring Nevada Driving Privileges After a Permit DUI

Reinstatement depends on the suspension or revocation involved and any court orders. Nevada DMV's DUI guidance lists these common steps:

• Complete the required suspension or revocation period.
• Complete DUI school, treatment or a victim impact panel when required.
• Maintain SR-22 proof of financial responsibility when required.
• Install and maintain an ignition interlock device if ordered.
• Pay the applicable alcohol/drug reinstatement fee and victim impact fee.
• Pass any DMV tests the Department requires for reinstatement.

The current Class C knowledge test has 25 multiple-choice questions and requires 20 correct answers for an 80% passing score. General retake timing and fees are covered in the dedicated failed-test article rather than repeated here.

See Nevada DMV DUI reinstatement guidance, current DMV fees and current knowledge-test format.

DMV Testing After a DUI Revocation

Nevada DMV may require knowledge and/or skills testing as part of reinstatement, depending on the case. Do not assume every DUI reinstatement follows exactly the same testing steps; follow the requirements on the DMV reinstatement record.

Ignition Interlock Device Requirements

If an ignition interlock is ordered, use a state-approved provider and follow the order for the full required period. Installation and maintenance costs are the driver's responsibility.
