If you knowingly lend your Montana learner permit or allow another person to use it, you can face criminal penalties and possible MVD licensing action. If the permit was used without your permission, report the misuse promptly; those two situations are not the same.
QUICK NAVIGATION
Montana law treats a learner permit as a personal credential. Knowingly lending it, allowing another person to use it, or using someone else's credential as your own is prohibited under MCA 61-5-302.
| Situation | What Changes |
|---|---|
| You knowingly lent the permit | You can face the misdemeanor penalty for unlawful use, and MVD may suspend or revoke driving privileges depending on the case. |
| The permit was used without your permission | Report the misuse promptly. Do not treat the victim as automatically guilty of knowingly lending the credential. |
Yes. Montana's credential-misuse law separately prohibits lending a driver credential or knowingly allowing another person to use it. The rule is not limited to someone driving a vehicle.
Knowingly allowing another person to use your permit as their own identification can still create legal exposure. That is different from the permit being stolen or used without your permission.
If you knowingly lend your permit, the unlawful-use misdemeanor can carry a fine of up to $500, up to six months in jail, or both. MVD may also suspend or revoke driving privileges for unlawful or fraudulent use; suspension is not automatic in every case.
If someone used the permit without your knowledge, document that fact promptly with law enforcement and MVD so you have a record for disputing misuse.
Permit misuse can create identity and driving-record problems even when the card holder did not authorize it.
If the permit was stolen or used without permission, report the misuse to local law enforcement and contact Montana MVD. Keep copies of the report and any MVD correspondence so you can dispute activity tied to the misuse. Do not assume an unauthorized victim's permit is automatically suspended or that a fixed reapplication wait applies; any licensing action depends on the actual facts and MVD or court action.

"The AI mock tests were surprisingly realistic. The explanations for road signs helped me understand the logic, not just memorize. Passed my permit test on the first try!"
