What Happens If a Missouri Permit Holder Refuses a Breath or Chemical Test?

Refusing a requested alcohol or drug test can trigger a separate one-year Chemical Revocation. It is different from a BAC-based Zero Tolerance suspension. Missouri DOR says some drivers under a chemical revocation may qualify for a Limited Driving Privilege if they meet the requirements. See DOR's chemical-test refusal FAQ.

What Is the 15-Day Permit After a Missouri Alcohol Arrest?

For an administrative alcohol action, the notice can include a 15-day driving permit before the suspension or revocation takes effect. The effective date is generally 15 days after the arrest or after an administrative hearing decision is mailed. See Missouri DOR Administrative Alcohol FAQs.

What Are Missouri's DUI Criminal Penalties and Court Proceedings for Permit Holders?

A BAC of 0.08% or higher while holding a Missouri permit is charged as a standard DWI under RSMo 577.010. First-offense penalties include up to six months in jail, fines up to $1,000, and mandatory SATOP enrollment.

A DUI charge results in separate criminal proceedings. Penalties escalate based on your Blood Alcohol Content (BAC).

Check the Missouri learner's permit guide for current rules and fees.

All Missouri permit requirements are covered in the Missouri permit guide.

BAC 0.02%-0.079%: This can trigger the under-21 administrative Zero Tolerance process, but it does not automatically mean a Minor in Possession charge. Any criminal or court charge depends on the facts and the offense actually alleged.
BAC 0.08% or Higher: Charged as a standard DUI, a Class B Misdemeanor. Penalties include up to 6 months in jail and fines up to $1,000.
A Kansas City teen pleaded to a first-time DUI. The court sentenced them to 48 hours of community service, two years of probation, and mandatory SATOP completion, costing over $2,000 with fines and fees.
You must complete a Substance Abuse Traffic Offender Program (SATOP). SATOP screening costs $375, and the education program costs $200. Find providers at dmh.mo.gov/alcohol-drug/satop.

What Are the Long-Term Consequences and Reinstatement Steps After a Missouri Alcohol-Related Permit Action?

For an under-21 .020%+ administrative alcohol action, a first relevant action is generally a 90-day suspension. The permit's original 182-day age does not restart. Intermediate License eligibility separately requires the preceding 12 months to be free of alcohol-related enforcement contacts.

Impact on getting an Intermediate License: The original permit issue date does not reset, but the required 12-month alcohol-contact-free period can delay eligibility.
Employment Impact: A DUI record can disqualify you from jobs requiring driving or a clean background for a decade or more.
SR-22: It is not required for a first under-21 .020% suspension, and it is not required for an MIP suspension. Missouri requires it for two years after a one-year MIP revocation.
Reinstatement fee: The alcohol-action reinstatement fee is $45. Complete any other requirements that apply to the specific Zero Tolerance, MIP or DWI action.

If an SR-22 is required for your specific action, confirm the filing requirement with DOR and your insurer before reinstatement. Do not assume
