Driving Alone Penalties
Missouri Permit Violation: Driving Alone Without Required Supervision (2026)
Driving alone with a Missouri instruction permit violates the permit supervision requirement.
What Are the Legal Penalties for Missouri Instruction Permit Violations?
Driving without the required qualified supervisor violates RSMo 302.130. The permit-rule violation is an infraction, and no points are assessed for that violation.
| Situation | What It Means |
|---|---|
| Valid permit, but driving alone | The supervision requirement is violated. The permit-rule violation itself is an infraction with no points. |
| A supervisor is present but does not qualify | Do not continue driving until a qualified supervisor is present. |
| Valid permit and qualified supervisor, but permit left at home | This is a separate permit-possession/display issue, not the same as driving without required supervision. |
Any separate offense cited during the same stop can have its own fines, points or other consequences. If no qualified driver can take the vehicle, it may also need to be left or towed.
Can You Drive Alone With a Missouri Permit If You Are 18 or Older?
No. As long as you are driving under an instruction permit, Missouri's supervision rule still applies. Turning 18 does not convert the permit into an unrestricted license. The permit statute requires a qualifying licensed operator beside the driver. See RSMo 302.130.
Can You Drive Alone to School or Work With a Missouri Instruction Permit?
No general school-or-work exception applies to an instruction permit. Those exceptions appear in Missouri's intermediate-license rules, not the instruction-permit supervision rule. A permit holder still needs a qualified supervisor.
Can a Missouri Permit Holder Drive Alone in an Emergency?
Missouri's instruction-permit statute does not provide a general emergency exception to the supervision requirement. If there is an immediate emergency, use emergency services or another qualified licensed driver rather than continuing to drive alone on the permit.
How Do Missouri Permit Violations Affect Your License Timeline?
The permit's original 182-day holding time does not reset to zero because of a conviction. For an Intermediate License, Missouri requires at least six months of permit holding time and no point-assessable nonalcohol traffic conviction during the preceding six months.
A supervision-only violation under RSMo 302.130 is not point-assessable. A separate moving violation during the same stop can still affect eligibility if it is point-assessable. See the Missouri traffic-violations guide for the broader points and suspension rules.
What Costs Can Follow a Missouri Permit Violation?
Court costs, towing and other expenses depend on the circumstances and any separate charges from the stop. Insurance effects also vary by carrier and driving record; see the dedicated Missouri insurance-cost guide for that topic.
Can a Missouri Permit Violation Appear on Your Driving Record?
A supervision-only violation under RSMo 302.130 carries no points. Other moving violations cited during the same stop may be point-assessable and can appear on the Missouri driving record. Check the DOR record and the dedicated traffic-violations guide if another offense was cited.
