To drive with a Massachusetts learner's permit, you must have a qualified supervising driver in the front passenger seat. This person must be at least 21 years old, hold a valid driver's license, and have at least one year of driving experience.
During normal permit-driving hours, the supervisor can be a parent, sibling, spouse, friend or another adult if they are at least 21, hold a valid license, have at least one year of driving experience, and sit in the front passenger seat.
Can a Massachusetts learner's permit supervisor sit in the back seat? No. The qualified supervising driver must occupy the seat beside the learner, which means the front passenger seat.
| Potential Supervisor | 5 AM-Midnight | Midnight-5 AM for Permit Holder Under 18 |
|---|---|---|
| Parent or legal guardian who meets the license requirement | Qualifies | Qualifies |
| Sibling, friend or other adult age 21+ with at least 1 year of driving experience | Qualifies | Does not satisfy the special nighttime rule for a non-emancipated minor |
| Qualified adult age 21+ supervising an emancipated minor | Qualifies | Qualifies if the adult holds a valid license, has at least 1 year of driving experience, and sits beside the learner |
| Driver under 21 | Does not qualify | Does not qualify |
| Driver with a suspended or revoked license | Does not qualify | Does not qualify |
For a non-emancipated permit holder under 18, the midnight-to-5 AM rule is narrower and generally requires a qualifying parent or legal guardian. Emancipated minors have a separate nighttime exception explained below.
An emancipated minor has a specific exception to the normal parent-or-guardian nighttime rule. Between midnight and 5 AM, the accompanying driver may be another qualified adult age 21 or older with a valid license and at least one year of driving experience, seated beside the learner.
No. The supervising driver can be licensed by another state. The adult still must be at least 21, have at least one year of driving experience, hold a valid license for the class of vehicle being driven, and sit beside the permit holder.
Can different adults supervise different Massachusetts permit practice drives? Yes. Massachusetts does not require one named adult to supervise every practice drive. Each supervising adult must independently meet the age, license, driving-experience and seating requirements for that trip.
Does the Massachusetts one-year supervisor requirement mean one year of licensed driving experience? Yes. The rule is based on driving experience: the supervising adult must have at least one year of driving experience and a valid qualifying license. It is not a requirement that one specific person supervise you for a full year.
Massachusetts law makes the accompanying licensed operator liable for violations of Chapter 90 or applicable motor-vehicle regulations committed by the learner while that person is supervising, except when the accompanying person is an RMV examiner acting in an official capacity.
Your supervisor must remain legally able to drive and able to supervise safely. A suspended or revoked license does not qualify. Detailed alcohol and OUI rules belong in the dedicated DUI article.
An out-of-state supervisor still must meet the Massachusetts age, experience and valid-license requirements while supervising a Massachusetts permit holder.
Does the supervisor need to carry their driver's license while supervising? The supervisor should have a valid driver's license available so their eligibility can be confirmed if needed. The key legal requirement is that the supervising driver actually holds a valid qualifying license and remains legally able to drive.
Once the supervising adult no longer holds a valid qualifying license, that person no longer meets the permit-supervision requirement. The learner should stop driving and arrange another qualified supervisor before continuing.
The supervisor must remain in the front passenger seat, stay able to supervise, and keep a valid license. If the supervisor becomes impaired, is arrested, or is found not to qualify, the permit holder should stop driving and arrange another qualified driver.
Violation-specific suspensions and court consequences belong in the dedicated Driving Alone and Supervisor Pulled Over guides. Insurance requirements are covered separately in the insurance article.
"The AI mock tests were surprisingly realistic. The explanations for road signs helped me understand the logic, not just memorize. Passed my permit test on the first try!"
