A traffic conviction while you hold a Maine learner's permit can lead to fines, demerit points when the offense carries points, and in some cases a separate BMV suspension. Different systems apply to ordinary points, designated convictions, provisional-license rules and alcohol-related suspensions. Maine learner's permit guide
The Maine Bureau of Motor Vehicles (BMV) treats these violations seriously, and they can impact your insurance costs and timeline to a full license.
| Points Accumulated | Consequence |
|---|---|
| 6 points in 1 year | Warning notice from Secretary of State |
| 12 points in 1 year | License suspension |
| Points retention | 1 year from conviction date |
| Point reduction | Approved driver improvement course (confirm with BMV) |
| OUI (first, adult) | 150-day administrative suspension (typical) |
| OUI (under 21) | 1-year suspension for any BAC violation |
Fines vary by violation and court; check your citation for the exact amount due. Points are recorded on your driving record from the conviction date and generally remain for one year - check the BMV for the exact retention period.
| Violation | Typical Fine (with fees) | Demerit Points |
|---|---|---|
| Speeding 1-10 mph over | $175-$210 | 2 points |
| Running a red light | $250-$300 | 3-4 points |
| Stop sign violation | $200-$230 | 2-4 points |
| Texting/handheld device | $250-$300 | 1-2 points |
| Following too closely (tailgating) | ~$200 | 2 points |
| Seatbelt violation | $50-$75 | 0 points |
Example: A Portland teen paid a total of $210 for a speeding ticket (8 mph over) in South Portland. The 2-point violation added a 30-day delay to her permit holding period before she could schedule her road test.
Can I get points while I hold a learner's permit? Yes. Point-bearing convictions are recorded under Maine's demerit-point system.
| System | What it means |
|---|---|
| Ordinary demerit points | Points from qualifying convictions accumulate; warning at 6 and suspension at 12 or more. |
| Designated convictions | Some convictions can trigger a separate suspension even without reaching 12 points. Operating alone on a learner's permit is listed among convictions for which privileges may be suspended for 30 days. |
| Provisional/intermediate-license rules | These apply after the learner stage and should not be treated as learner-permit curfew or passenger rules. |
| Under-21 alcohol / criminal OUI | Under-21 zero tolerance and criminal OUI are separate systems with different thresholds and consequences. See the DUI/OUI article in this cluster for details. |
The learner's permit itself does not have the intermediate-license midnight curfew or passenger restriction, so those should not be listed as learner-permit ticket categories.
You can obtain your Maine driving record from the BMV, including through the state's online driving-record service. The record shows your driving history; if you need help interpreting a suspension or point issue, contact Driver License Services.
Changing from a permit to a driver's license does not create a fresh driving record. Maine's published point system ages points based on the conviction date, so licensing progression does not by itself erase them.
Do not treat it as simply reaching the normal 12-point threshold. Maine lists operating alone on a learner's permit among designated convictions for which privileges may be suspended for 30 days.
Will a permit violation affect my future driver's license? It can. A suspension, unresolved ticket or serious conviction can delay licensing until the issue is resolved.
Do not plan on progressing to the road test while your driving privilege is under an active suspension. Resolve the suspension and any reinstatement requirements first, then confirm your current road-test eligibility with BMV.
After receiving a ticket, you must respond by the date on the citation, usually by paying the fine or requesting a court hearing. Ignoring a ticket leads to additional fines and possible suspension.
Just So You Know: Check your driving record online at the Maine BMV website before scheduling your road test to avoid a last-minute rejection for unresolved tickets or points you forgot about. A Bangor teen had his test canceled at the BMV office because an unpaid seatbelt fine from months prior had triggered an unresolved suspension flag on his record.
Straight From the DMV: When paying a fine, get a certified receipt. Keep it with your permit documents as proof of resolution. The Augusta BMV office often has applicants reschedule because their payment confirmation from the court hasn't been processed in the state system, showing an outstanding balance.
Can an unpaid traffic ticket suspend my Maine learner's permit? Yes. Maine law allows the license or permit to be suspended for failing to answer, appear or pay a traffic-infraction fine within the required time. Resolve the ticket and any reinstatement requirements before driving again.
"The AI mock tests were surprisingly realistic. The explanations for road signs helped me understand the logic, not just memorize. Passed my permit test on the first try!"
