Maine Learner's Permit Driving Rules: Supervision, Phone Use, Passengers and Night Driving (2026)

Maine learner's permit driving rules cover supervision, phone use, passengers, night driving, and the age-based practice requirements that apply before licensing.

Can I drive alone with a learner's permit in Maine?

No. Driving alone with a Maine learner's permit is strictly prohibited. A licensed supervisor 20+ years old with 2+ years of experience must sit in the front passenger seat at all times. Maine learner's permit guide

• No general emergency exception: Maine's learner's permit statute requires a qualified accompanying operator when you drive under the permit.
• Public ways and parking areas: Keep the supervision rule in mind anywhere Maine's licensing laws apply. Do not assume the same rule automatically covers every type of private property.
• Driving alone: Solo driving can lead to separate licensing consequences; see the dedicated driving-alone page for the specific penalties.

Can I drive alone in a parking lot with a Maine learner's permit?

Do not use a parking lot as a way around the supervision requirement. Maine's motor-vehicle laws separately address public ways and parking areas, so supervised practice should still be done with the qualified accompanying driver beside you.

What can I do with a learner's permit in Maine?

A Maine learner's permit allows you to practice driving under strict supervision. You can develop skills for your road test.

• Drive with a qualified supervisor in the front seat.
• Practice on city streets, rural roads, and highways.
• If you are under 21, log the required 70 hours of supervised driving, including 10 hours after dark.
• Learn to handle Maine's specific conditions like winter weather and wildlife.

Read This Carefully: If you are under 21, record each practice session accurately on Form MVE-21 as you go. The completed log has a final certification requirement; a parent signature is not required after every individual drive.

Core Maine Learner's Permit Restrictions

All permit holders must follow these core rules, part of Maine's Graduated Driver Licensing program.

• Supervised driving only: A licensed driver 20+ with 2+ years experience must be in the front seat.
• Alcohol under 21: If you are under 21, an alcohol level above 0.00 can trigger Maine's zero-tolerance consequences.
• Phone ban: Learner's permit holders may not use handheld or hands-free mobile-phone functions while operating under the permit.
• Seat belts: Mandatory for everyone in the vehicle.

Can I use Bluetooth or hands-free calling with a Maine learner's permit?

No. Maine's hands-free exception does not apply to a learner's permit holder while operating under the permit.

Can I use my phone after pulling over with a Maine learner's permit? Yes, once you have pulled safely to the side of or off the public way and stopped before using the device.

Learner's Permit vs. Intermediate License

Can You Drive at Night With a Maine Learner's Permit?

Yes. Maine does not impose the intermediate-license midnight-to-5 a.m. curfew on a learner's permit. A qualified supervising driver must still be beside you whenever you practice.

If you are under 21, your required supervised practice includes at least 10 hours after dark.

Can You Drive With Passengers on a Maine Learner's Permit?

Yes. Maine's ordinary Class C learner's permit does not have the intermediate-license family-only passenger restriction. The required qualified supervisor must still sit beside the learner.

Friends, siblings, and other passengers do not become prohibited simply because the driver is under 18. Everyone must still follow seat-belt and other applicable traffic-safety laws.

Are Maine learner's permit passenger rules the same as intermediate-license passenger rules?

No. The passenger and midnight-curfew restrictions commonly associated with Maine's graduated licensing system apply at the intermediate-license stage for drivers under 18, not to the learner's permit itself.

Visit the Maine learner's permit guide for step-by-step rules.

Can You Drive on Highways or to School With a Maine Learner's Permit?

Can I drive on the freeway with a learner's permit in Maine?

Yes, with your supervisor. Practice is encouraged on routes like I-95, I-295, and US-1.

• Use right lanes initially.
• Maintain a 4-second following distance.
• Practice merging at speed (60+ mph) for the road test.

Can I drive to school with a learner's permit in Maine?

Yes, if a qualified supervisor is with you. This is considered a valuable practice opportunity.

• Plan for extra time for parking lot practice.
• It helps you log required hours.
• The learner-permit phone ban still applies when driving to or from school.

Consequences of Breaking a Maine Learner's Permit Rule

The consequence depends on the specific violation; there is no single fine, point total, suspension period, insurance increase, or practice-log reset that applies to every permit violation.

• Driving alone: Maine treats this separately from ordinary accumulated demerit points.
• Phone use: Maine has a specific mobile-device rule for learner's permit holders.
• Alcohol under 21: Maine's zero-tolerance consequences are separate from the general criminal OUI rules.

For exact consequences, see the dedicated driving-alone, traffic-violation, and OUI pages for the violation involved.

Common Maine Learner's Permit Rule Mistakes

• Confusing the intermediate-license midnight curfew with learner's permit rules.
• Assuming the intermediate-license passenger restriction applies during supervised permit practice.
• Assuming hands-free calling is allowed because Maine has a general hands-free law.
• Treating the 70-hour and six-month requirements as under-18 rules instead of under-21 rules.

Do Maine Learner's Permit Rules Change by Location?

The statewide learner's permit requirements do not change simply because you are in a rural or urban part of Maine.

• The qualified-supervisor and learner-permit phone rules are statewide.
• Maine law distinguishes public ways, parking areas, and private ways, so do not make blanket assumptions about every type of private property.
• If you are under 21, the six-month permit holding period and 70-hour supervised-practice requirement still apply before licensing.
