Illinois Permit Driving Rules

Select Topic

Illinois Permit Restrictions: Curfew, Solo, and Fines

An Illinois Instruction Permit allows you to practice driving under strict rules. You cannot drive alone. A qualified supervisor must be in the front seat at all times.

Violating these restrictions results in fines, permit suspension, and delays in getting your license.

Who Can Legally Sit in the Passenger Seat With an Illinois Permit Holder?

Your supervisor must be at least 21 years old, hold a valid Illinois drivers license for at least one year, and be seated in the front passenger seat. Probationary licenses do not count toward the one-year rule.

  • Supervisor Requirements: Must be at least 21, hold a valid drivers license for the vehicle type, and have at least one year of driving experience. Learn more about supervising driver rules.
  • Moving the Car: Operating a vehicle in a driveway or parking lot counts as driving and requires a supervisor present.

Download the Illinois Rules of the Road for full supervision requirements.

What Charge Applies When an Illinois Permit Holder Drives Solo?

Driving without a supervisor is Driving Without a Valid License - a Class A Misdemeanor carrying up to $2,500 in fines and up to one year in jail.

A Naperville teen was ticketed for driving alone to school after dropping his mom at work: $250 fine, a 3-month extension of his permit period, and revoked school parking privileges.

How Many Supervised Hours Does Illinois GDL Require for Permit Holders?

Complete 50 hours of supervised practice driving including 10 hours of night driving between sunset and the start of curfew. Log them on Form DSD X 152.

What Illinois GDL Law Forbids for Instruction Permit Holders

Permit holders can drive on all public roadways including freeways - with a qualified supervisor. Everything else is restricted.

  • Freeway Driving: You can drive on freeways. Start on less busy routes like I-355 off-peak before attempting congested roads like I-90/94.
  • Drive-Thrus: You can drive through a drive-thru with your supervisor present.
  • Driving to School: Only with a qualified supervisor in the passenger seat. No exceptions for solo driving.

At the Naperville SOS, one parent signed the consent form correctly - but the witness line was left blank. Incomplete; witness must also sign, and the return visit had to happen within 4 days. The IL consent form requires a separate witness signature in addition to the parent signature - two signatures, not one.

What Is the Illinois GDL 10 PM Curfew Rule for Instruction Permit Holders?

Night driving must end before curfew. Log 10 of your required 50 hours between sunset and curfew start.

DaysCurfew (No Driving)
Sunday-Thursday10:00 PM to 6:00 AM
Friday-Saturday11:00 PM to 6:00 AM
  • Curfew Exemptions: Exceptions for work, school, or religious activities require official verification. Your supervisor is still required.

Cell Phones and Passengers Are Both Restricted for Illinois Permit Holders

Supervisor occupies the front seat. Back passengers are limited to the number of working seatbelts. Drivers under 19 face a total cell phone ban including hands-free.

  • Passenger Limits: The front seat is for your supervisor only. Back seat passengers are limited to the number of working seatbelts.
  • Cell Phone Ban: Drivers under 19 cannot use any cell phone while driving, including hands-free devices. Texting is illegal for all drivers.

What Happens to the Illinois GDL Clock After a Permit Violation?

Moving violations reset the 9-month license eligibility clock to zero - the most expensive penalty is not the fine, it is the time lost.

ViolationPenalty
First Cell Phone Offense$75 fine plus court costs
Curfew Violation2-month permit suspension, fines up to $1,000
Moving ViolationResets the 9-month waiting period before license eligibility

A Springfield teen received a speeding ticket during his permit phase - his 9-month waiting period reset to zero from the violation date, delaying his license by several months. Before your road test, check your vehicle brake lights, turn signals, and horn with your supervisor. A failed equipment check is an automatic reschedule at Illinois SOS facilities.
