If a police stop with a learner driver occurs in Delaware, both the permit holder and the supervising driver face legal scrutiny.
If a police stop with a learner driver occurs in Delaware, the consequence depends on who committed the violation. A learner's moving violation is charged to the learner; a Level One restriction violation can affect the permit; the supervisor's own license problem or arrest is a separate issue; and the sponsor-specific misdemeanor rule applies only in the supervision situation described below.
Both individuals have specific duties.
In Newark, an officer pulled over a permit holder for a rolling stop. The supervisor, a parent, could not produce their physical driver's license, only a digital photo. The officer issued the learner a citation for the stop sign violation and the parent a warning for failing to present a license, delaying the stop by 25 minutes. Download the full Delaware GDL Learner's Permit Law PDF for complete restrictions.
The Delaware learner's permit guide has full eligibility details.
The adult may no longer qualify to supervise the learner. The permit holder should not continue driving until another person who meets Delaware's supervisor requirements is present and able to take responsibility for the trip.
| Violation Type | Legal Code | Consequence |
|---|---|---|
| Violating Permit Restrictions | Delaware law(h), penalized under state law | 2-month suspension (1st offense) |
| Sponsor knowingly allowing a required-supervision violation | Delaware law(e)(6) | Unclassified misdemeanor |
| Cell Phone Use While Driving | Delaware law | $100 civil penalty for a first offense; no motor-vehicle points for the electronic-device violation itself |
Do I get a permit penalty if my supervisor receives their own unrelated ticket? Not automatically. A citation issued only for the supervisor's own conduct does not by itself become a violation on the learner's permit. The learner can still face separate consequences if the learner also violated a traffic or GDL rule.
If a supervisor is arrested during a stop, whether the permit holder can continue driving depends on the Level One phase, the time of day, and the other GDL restrictions. During the first 6 months, or during hours when supervision is required later, another qualified supervisor must take over. After the first 6 months, an eligible Level One permit holder may drive unsupervised from 6:00 a.m. to 10:00 p.m. if all other restrictions are met.
During a traffic stop in Wilmington, a supervising driver was arrested for an active warrant. The 16-year-old permit holder called a family friend who met the age/license requirements to come and drive the car home, avoiding an expensive impound fee and a separate violation.
Do not continue with an impaired or otherwise incapable person acting as the required supervisor. If supervision is required at that time, arrange for another qualified supervisor before the learner drives again. A second-phase Level One holder may drive unsupervised only during the permitted 6:00 a.m. to 10:00 p.m. window and only when all other restrictions are satisfied.
During supervised driving, no one else may sit in the front seat. All passengers must wear a seatbelt. The permit holder cannot use any cellular or electronic device while driving. Suspension time does not count toward the required 12 months, it is added to the end. See GDL law at dmv.de.gov. "The AI mock tests were surprisingly realistic. The explanations for road signs helped me understand the logic, not just memorize. Passed my permit test on the first try!"

"The readiness score gives you so much confidence. I knew exactly when I was ready to take the test. Highly recommend Shoro for anyone nervous about their exam."
