Colorado Permit Supervisor Rules: Who Can Supervise a Learner Driver?

Colorado law limits who may supervise a learner driver. The exact rule depends on the supervisor's relationship to the minor, driver-license status, and whether Form DR 2460 names an Alternate Permit Supervisor.

Who Can Legally Supervise a Colorado Learner's Permit Holder?

For a minor instruction permit, Colorado authorizes specific supervisor categories. These include qualifying parents or stepparents, certain grandparents or foster parents, an adult age 21 or older who signed the affidavit of liability, an approved driver education instructor, and an Alternate Permit Supervisor appointed as allowed by law. The applicable supervisor normally must hold a valid Colorado driver's license, with a limited military exception for the person who signed the affidavit of liability.

Supervisor Age and Relationship Rules

Colorado's instruction-permit supervision rules depend on both the person's relationship to the minor and the legal authorization used.

• Minimum age: A person serving as the adult signer or Alternate Permit Supervisor must meet the applicable age requirement; a 20-year-old cousin does not qualify as a 21+ supervisor.
• Parent or guardian: A parent, stepparent, guardian, qualifying grandparent, or foster parent may supervise when the current statutory requirements are met.
• Alternate Permit Supervisor: If the person assuming liability does not hold a valid Colorado driver's license, an eligible Alternate Permit Supervisor can be appointed as provided on Form DR 2460.

Does a Colorado permit supervisor have to be listed on Form DR 2460?

Not every authorized supervisor is necessarily the person who signed the affidavit of liability. What matters is that the person fits an authorized supervisor category. When an Alternate Permit Supervisor is used, that appointment is recorded on Form DR 2460.

Can a 21-year-old sibling supervise a Colorado learner's permit holder?

Yes, but age alone is not enough. The sibling must hold the required valid driver license and must fit an authorized supervisor route, such as being the adult who signed the affidavit of liability or being properly appointed as an Alternate Permit Supervisor.

Driver License, DR 2460, and Supervisor Authorization Rules

The supervisor must fit one of Colorado's authorized categories and must be legally able to supervise. Form DR 2460 handles the liability signer and, when needed, the Alternate Permit Supervisor.

Does a Colorado permit supervisor need a Colorado driver's license?

Generally, the authorized supervisor routes for a minor permit rely on a valid Colorado driver's license. The main exception addressed by the current rules is for the person who signed the affidavit of liability and has a valid out-of-state license plus proper military identification.

Can someone with an out-of-state driver's license supervise a Colorado permit holder?

Not as a general rule. The current form recognizes the out-of-state-license route when the liability signer also presents proper military identification. Otherwise, a signer who lacks a Colorado license can appoint a qualifying Alternate Permit Supervisor with a valid Colorado license.

What happens if the person who signed DR 2460 does not have a Colorado driver's license?

They can appoint an eligible Alternate Permit Supervisor on Form DR 2460. If the signer holds a valid out-of-state license and has proper military identification, the specific military exception may apply instead.

• Stay capable of supervising: A supervising passenger should be sober, alert, and able to help the learner. Do not describe the passenger as automatically committing DUI or DWAI merely because the learner is driving; those offenses depend on who is driving or in actual physical control.
• Seating position: The supervisor must occupy the position required by the applicable permit rule, generally the front passenger seat for a passenger vehicle.
• If the supervisor becomes unqualified: The learner should not continue driving without another legally qualified supervisor. Detailed traffic-stop consequences belong in the Supervisor Pulled Over guide.

Common Colorado Permit Supervisor Problems and How to Avoid Them

• Using someone who is old enough but not legally authorized. Being 21 or older by itself does not satisfy every supervisor requirement.
• Skipping the Alternate Permit Supervisor step. If the liability signer lacks a Colorado license and no military exception applies, make sure the eligible alternate is properly appointed before supervised driving begins.
• Continuing after the supervisor can no longer legally supervise. If a traffic stop, license problem, or other event leaves the supervisor unable to qualify, the learner should not simply drive away. See the dedicated Supervisor Pulled Over guidance.
