When a learner is driving and police make a traffic stop, the officer can check both the permit holder and the supervising driver. Any citation depends on who committed the violation and whether the supervision itself was legally valid.
The permit holder must present the instruction permit and comply with the rules that apply to the learner. The supervising driver must hold a valid California license and be able to take control of the vehicle.
Do not treat provisional-license curfew or passenger restrictions as automatic instruction-permit rules.
A supervisor's own citation does not automatically become the learner's citation. The moving violation belongs to the person who actually committed it.
| What Happened | Who Is Responsible? |
|---|---|
| The learner speeds or commits another moving violation | The learner is the driver and can be cited for that driving conduct. |
| The supervisor commits a separate offense | The supervisor is responsible for that separate conduct; it does not automatically add points to the learner's record. |
| The supervisor is not legally qualified to supervise | The learner may no longer be driving under valid supervision and should stop until a qualified supervisor is available. |
A normal citation does not automatically disqualify an otherwise valid supervisor. The key question is whether the supervisor still has a valid qualifying California license and remains able to supervise and take control of the vehicle.
If the supervising driver is arrested, becomes impaired, loses the ability to supervise, or is found not to hold a valid qualifying license, the learner should not continue driving alone.
Arrange another qualified supervisor. For a minor permit holder, that person must be at least 25; for an adult permit holder, at least 18.
Stop the practice drive. A suspended or revoked license does not satisfy the requirement for a qualifying supervising driver.
Do not continue the practice drive with that person as the supervisor. DMV requires the accompanying driver to be positioned and able to assist with control of the vehicle when necessary.
Yes, if that person meets the applicable California licensing and age requirements and can sit close enough to take control. For a minor learner, the practice supervisor must be at least 25; for an adult learner, at least 18.
Learner commits the moving violation: if the permit holder is driving and speeds or fails to stop, the learner can be cited because the learner was operating the vehicle.
Supervisor's license is invalid: if the supervisor is not legally qualified, the learner should stop driving and arrange another qualified supervisor.
Supervisor is arrested or cannot continue: the learner should not simply drive the vehicle home alone. Another qualified driver should take over.
If the learner's own driving privilege is suspended because of a separate violation, do not drive until the DMV action is cleared. The Traffic Violations on Permit article covers suspension and reinstatement details.
"The AI mock tests were surprisingly realistic. The explanations for road signs helped me understand the logic, not just memorize. Passed my permit test on the first try!"
