California Driving Rules for Foreign License Holders, Visitors, and International Students

Foreign visitors, international students, and California residents do not all follow the same rule. A valid foreign license may be used by an adult visitor who remains a nonresident, while a person who establishes California residency must follow California licensing requirements. F-1 or M-1 visa status by itself does not automatically establish California residency.

California DMV Requirements for International Students

International students must first determine whether they are California residents for DMV purposes. Visa category alone does not make someone a California resident.

If an applicant is legally present in the United States but is not eligible for a Social Security number, California DMV can exempt the applicant from the SSN requirement after eligibility is verified. Do not treat an SSA denial letter as a universal requirement for every applicant without an SSN.

Applicants still need the identity, legal-presence, and California residency documents required for their specific credential path.

Driving with a Foreign Instruction Permit or License

Foreign Instruction Permit: You cannot drive solo in California with a foreign learner's permit. It is not valid for driving without a licensed supervisor.

Foreign Driver's License: If you have a valid foreign driver's license, the rules depend on your status:

• Tourist/Visitor: You may drive on your foreign license. An International Driving Permit (IDP) is recommended if your license is not in English.
• California Resident (Student): Your foreign license is only valid for the first 10 days after establishing residency. After that, you must get a California license starting with an instruction permit, pass the written and driving tests, and surrender your foreign license to the DMV when applying for your California driver's license.

There is no reciprocity. You must take all tests. An adult with a foreign license does not have a mandatory waiting period and can schedule the driving test immediately after passing the written exam.

Can a Visitor Drive in California With a Valid Foreign Driver's License?

Yes, an adult nonresident visitor may generally drive in California with a valid license from the visitor's home country while remaining a nonresident.

When Does a New California Resident With a Foreign License Need a California License?

Once you establish California residency, follow California's resident licensing rules rather than relying indefinitely on visitor status or a foreign license.

Visitor vs. California Resident: When Do You Need a California License?

An adult visitor who remains a nonresident may drive in California with a valid foreign driver's license. Once a person establishes California residency, California's resident licensing requirements apply.

Residency depends on the person's facts and actions; simply holding an F-1, M-1, B-1, or B-2 visa does not by itself decide California DMV residency status.

What if I Am Legally Present in the U.S. but Not Eligible for an SSN?

California DMV can exempt a legally present applicant from the SSN requirement after DMV verifies that the person is not eligible for an SSN. Do not assume an SSA denial letter is always required.

Do Foreign-License Holders Have to Take a California Driving Test?

Yes. DMV says an applicant applying for an original California driver license with a foreign-country license must take the California driving test.

Do I Need Another Licensed Driver to Accompany Me to and From the Drive Test if I Have a Foreign License?

Yes. DMV says a foreign-license holder taking the California drive test must be accompanied by a California-licensed driver who can drive the vehicle to and from the test.

Applying for a California License With Foreign or Limited-Term Documents

For an applicant who needs a California license, the DMV verifies identity and legal presence and requires the documents appropriate to the applicant's status. If the applicant is legally present but not eligible for an SSN, DMV verifies that ineligibility rather than requiring an SSA denial letter in every case.

The standard Class C application fee is $46. Complete the DL/ID application before the visit and bring the original documents DMV requires for your credential path.

Do Not Drive After Your Foreign-License Privilege Is No Longer Valid

Do not drive after your foreign-license privilege is no longer valid for your California status, and do not use a California instruction permit outside its supervision rules. Detailed unlicensed-driving penalties belong in the dedicated traffic-violation and driving-alone guides.

If you are unsure whether you are still a nonresident visitor or have established California residency, confirm your licensing status before driving.
