During a traffic stop, the permit holder must still satisfy the instruction-permit supervision rule, and the supervisor must remain a qualified licensed driver. A supervisor's own citation is separate from a violation committed by the permit holder.
The officer may check the permit holder's physical credential and the supervising driver's license. The key question is whether the supervisor still meets Arkansas's supervision requirement.
| What happened | Whose issue is it? |
|---|---|
| The permit holder committed a violation | The permit holder can be cited. Any points depend on the specific recorded offense; some offenses carry 0 points. |
| The supervisor committed a separate violation | The supervisor's citation does not automatically become a permit-holder violation. |
| The supervisor is no longer qualified to supervise | The permit holder should not continue driving unless another qualified supervisor is present. |
For the full age/license requirements for the accompanying driver, see the dedicated Supervisor Requirements guide.
A supervisor must be a qualified licensed driver. If that person's license is suspended, expired, or otherwise invalid, the learner should not keep driving until a qualified supervisor is available.
Not automatically. A citation for the supervisor's own speeding, equipment, or other conduct is separate from the learner's conduct unless the learner also violated a rule or the supervisor no longer qualifies to supervise.
Age alone is not enough; the person must actually meet Arkansas's licensed-supervisor requirement. If the officer cannot verify a valid license, do not assume the learner can continue driving under that person.
Not every citation adds demerit points. DFA assigns points by offense, and some permit-related or phone-use violations carry 0 points.
See the dedicated Traffic Violations on Permit guide for points and suspension rules.
Supervisor cited: If the supervising adult is stopped for a separate equipment or speeding issue but remains legally qualified to supervise, that citation does not automatically create a violation for the permit holder.
Supervisor no longer qualified: If the supervisor's license is suspended, expired, or otherwise does not meet the supervision rule, the permit holder should not continue driving until a qualified supervisor is present.
Permit holder cited: If the learner commits a phone, speeding, or other offense, the permit holder's consequences depend on that specific offense. Do not assume every citation adds points or automatically suspends the permit.
Not with that person as the supervisor. The learner should wait until another qualified licensed adult can legally take over before driving again.
Can another qualified adult take over as supervisor after the stop? Yes, if the replacement adult meets Arkansas's supervisor requirements and is seated in the required position beside the permit holder.
If a traffic stop actually results in a suspension, reinstatement requirements depend on the reason for the suspension. Use the dedicated Traffic Violations on Permit guide and Arkansas DFA Driver Control instructions for the applicable fees, documents, or programs.
Pull over promptly and safely. Supervisor stays in the front seat. Hand the officer your physical permit and supervisor's license without being asked. Routine stops escalate when drivers are uncooperative or nervous.
"The AI mock tests were surprisingly realistic. The explanations for road signs helped me understand the logic, not just memorize. Passed my permit test on the first try!"
