Who Can Be Charged During a G1 Traffic Stop?

Common G1 Traffic-Stop Scenarios

What to Do During a Traffic Stop

If police pull over a vehicle where a G1 driver is at the wheel, both the G1 driver and supervising driver may face charges if any GDL conditions are violated.

If a police officer pulls over a vehicle where a G1 driver is behind the wheel, both the G1 driver and the supervising driver may face charges if any GDL conditions are violated.
The officer checks the supervisor's licence class, BAC, and seating position, not just the G1 driver's documents.
Prepare with Ontario G1 practice tests.

What Happens When Police Stop a G1 Driver With a Supervisor?

A traffic stop with a learner driver changes the rules.
The officer checks both the permit holder and the supervisor.
Your G1 licence is only valid if your supervisor meets all legal requirements.
If they fail, you are driving illegally.

What If Your G1 Supervisor Is Not Legally Qualified?

A G1 driver must be accompanied by a supervisor who meets Ontario's eligibility conditions. If the accompanying driver no longer qualifies, the learner can be driving in contravention of G1 conditions. Keep the full supervisor-eligibility rules in the dedicated Supervisor Requirements guide.

Supervisor Found Suspended During the Traffic Stop

A suspended licence does not qualify someone to supervise a G1 driver. The learner should not continue until another accompanying driver who meets all G1 requirements is in the required front passenger seat.

Who Can Be Charged During a G1 Traffic Stop?

Who Was Driving / What Happened	Who Can Be Charged
G1 learner is speeding	The G1 learner is the driver and can receive the speeding charge.
G1 learner drives while the accompanying driver is not qualified	The learner can face a charge for driving in contravention of G1 licence conditions. Separate offences may apply to the accompanying driver depending on the facts.
Accompanying driver exceeds the permitted BAC condition	The person may no longer qualify to supervise. Police can require testing and prevent the learner from continuing without a qualified supervisor; do not treat this alone as an automatic impaired-driving arrest.

Common G1 Traffic-Stop Scenarios

Speeding while the G1 learner is driving: the learner is the driver and can receive the speeding ticket. The supervisor does not inherit the learner's speeding offence.
Supervisor has a BAC that makes them ineligible to supervise: the G1 driver cannot continue unless another qualified supervisor is available. Do not assume an impaired-driving arrest or seven-day impound follows solely because the passenger-supervisor is over the G1 supervision BAC limit.
Supervisor licence is expired or otherwise invalid: the learner can be charged with driving in contravention of G1 licence conditions, not simply with having no valid licence. If nobody can legally take control of the vehicle, separate towing arrangements may be needed.

Continuing After the Supervisor Gets a Traffic Ticket

A traffic ticket by itself does not automatically disqualify the supervisor. The learner can continue only if the accompanying driver still has a valid qualifying licence and continues to meet every G1 supervision
